I genuinely wasn't sure where fan works should go in the forum structure, so please move this if it's wrong: as it's a books-based thing I thought I'd put it here.

So anyway, I wrote a song about Vimes. It is entitled "Boots". Thoughts all welcome etc :)

Hmm, not bad but a trifle slow. I preferred the "My Sheep Have Run Amok" song.

"I can give you 15 gold and at least 20 XP..." *LOL*

I wrote at least 500+ song parodies like this, but seeing as many of the originals are copyright Lennon/McCartney (or Madonna, or Nirvana, or Weird Al Yankovic, or whoever) I probably can't use them in a video. ;)

On the other hand, some of them are copyright Gilbert/Sullivan etc., so I can probably use those.

Oh, yes, this was definitely intended to be more in the "thoughtful fan song" rather than "bouncy joke song" category, whereas the Sheep song is very definitely in the latter bucket. :)

I think in most countries parody is treated as fair use (and indeed it's protected speech in the US), so you'd probably be fine, but I absolutely get not wanting to test that theory!

True. The Lennon Estate (and the Tolkien Estate, and others) are very protective.

In any case, when I create videos (and I've done a few), I don't use any elements of the video without clearing it with the original creator, first. (For instance, I created a video about the Gettysburg address, and found an image I wanted to use, but the copyright wasn't exactly clear. So, I emailed the original creator and asked for his blessing, which I received within a day or two). :)

Better safe than sorry, right?

Fair use is tricky. I have read that (in USA law, anyway) a legal parody is required to comment on the original somehow, yet most that I have seen weren't making comments or criticisms so much as making fun of the original by being absurd. Including full novels and stage productions - Weird Al Yankovitz does fun things but his parodies that I've seen don't seem to be making any criticism except by implying that the original was taking itself too seriously. So I guess that's sufficient.

Just using the tune to write an unrelated song is not technically a parody, despite hundreds of years of precedent.
I think a song that somehow expands on the original in a thoughtful way without being comic is probably legit, but I am not a lawyer.
